Terms of Service

1. About SealTransfer and these Terms

SealTransfer ("the Service", "we", "us", "our") is operated by No Fame GmbH, a company incorporated in Zurich, Switzerland (CHE-340.855.877). These Terms of Service ("Terms") govern your access to and use of sealtransfer.io and any associated applications or APIs.

By creating an account or using the Service in any way, you agree to be bound by these Terms. If you do not agree, do not use SealTransfer. We may update these Terms from time to time; we will notify registered users by email and/or in-app notification. Continued use after notification constitutes acceptance.

2. Definitions

• "Sender" - any person who uploads files and creates a Transfer, with or without a SealTransfer account.
• "Anonymous sender" - a Sender who uses the free service without an account, subject to free-tier limits (see §5 and §7).
• "Creator" - a registered user who uploads files, creates Transfers, and may charge Clients for download access.
• "Client" - any person who accesses a Transfer link and, where the Transfer is priced, makes a payment to download. Clients are not required to create an account.
• "Transfer" - a delivery link created by a Sender or Creator, containing one or more files, optionally priced.
• "Preview" - for priced Transfers only, a watermarked, lower-resolution version of a file, made available to Clients before payment.
• "Original" - the full-quality file uploaded by the Sender or Creator, accessible once the Transfer is retrieved (free) or after payment (priced).

3. Accounts

3.1 Registration

To create Transfers and receive payments, you must create a Creator account. You must provide accurate and complete information. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

3.2 Eligibility

You must be at least 18 years old to create a Creator account and connect a bank account via Stripe. Clients have no minimum age requirement to view a Transfer, but must be of legal age in their jurisdiction to enter into payment obligations.

3.3 Account suspension

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, generate excessive chargebacks, or upload prohibited content, with or without prior notice.

4. The Service - how it works

4.1 Free anonymous transfers

Any visitor can send up to 2 GB per Transfer without creating an account. Before the first upload, the sender must accept these Terms and the Privacy Policy via an on-page confirmation. To protect the service against abuse, a maximum of five finalized free Transfers per rolling 24-hour window is allowed per sender IP address. This limit does not apply to abandoned or incomplete Transfers.

4.2 Priced transfers by Creators

Creators with a registered account may set a price on a Transfer. When a Client pays, we collect the payment via Stripe, make the Original files available for download to the Client, hold the funds for 72 hours, then release the net amount (after platform and Stripe fees) to the Creator's connected Stripe account.

4.3 Our role

SealTransfer is a technology platform. For priced Transfers, we are not a party to the commercial relationship between Creator and Client and we do not review, endorse, or warrant the quality, lawfulness, or fitness of any files delivered through the Service. Responsibility for the content lies entirely with the Sender or Creator.

5. Payments, fees, and payouts

5.1 Payment processing

All payments are processed by Stripe (Stripe Payments Europe Limited and/or Stripe Technology Europe Limited). By using the payment features, you also agree to Stripe's Terms of Service. No Fame GmbH does not store credit card or bank account details.

5.2 Plans, subscriptions, and fees

SealTransfer offers three plans. Anonymous senders use the Free plan automatically. Registered Creators can subscribe to Pro or Studio for higher limits and a lower platform fee on priced Transfers.

Stripe processing fees (approximately 2.9% + CHF 0.30 per transaction) are additional and borne by the Creator. All subscription prices are exclusive of applicable VAT, which is added at checkout where required. Subscriptions renew automatically at the end of each billing cycle and can be cancelled at any time from the account settings; the subscription remains active until the end of the current paid period.

5.3 The 72-hour release window

Upon successful payment by a Client, funds are captured immediately but held for 72 hours before being released to the Creator's connected Stripe account. This window allows time to resolve disputes. The release window is non-negotiable and applies to all plans, including Pro and Studio. No Fame GmbH is not responsible for any losses arising from chargebacks during this window.

5.4 Disputes and chargebacks

If a Client initiates a chargeback with their bank or card issuer, the relevant payment will be frozen immediately. No Fame GmbH will contact the Creator to collect evidence (access logs, file delivery confirmation) for submission to Stripe. No Fame GmbH does not guarantee the outcome of any dispute. Creators who generate an excessive rate of disputes may have their accounts suspended.

5.5 Refunds

Once a Client has downloaded the Original files, the transaction is considered complete and non-refundable. Refund requests before download will be assessed on a case-by-case basis. No Fame GmbH has no obligation to issue refunds beyond what is required by applicable Swiss law.

6. Intellectual property and content

6.1 Creator ownership

Creators retain full ownership of all files uploaded to SealTransfer. By uploading files, you grant No Fame GmbH a limited, non-exclusive, royalty-free licence to store, process, transcode (for watermarking purposes), and serve those files solely to operate the Service.

6.2 Content warranty

By uploading files, you warrant that: (a) you own or have the necessary rights to all uploaded content; (b) the content does not infringe any third-party intellectual property rights; (c) the content does not violate any applicable law; (d) the content does not constitute illegal material of any kind.

6.3 Prohibited content and acceptable use

The categories below summarise what you may never deliver through SealTransfer. The authoritative and more detailed list - including Stripe-restricted activities, transaction-laundering patterns, the enforcement mechanics, and the two-strike system that governs account suspensions and bans - is set out in our separate Acceptable Use Policy, which forms an integral part of these Terms. Violations result in immediate account action and, where required by law, reporting to relevant authorities:

• Child sexual abuse material (CSAM) or any content that sexualises minors.
• Content that incites violence, hatred, or discrimination.
• Malware, viruses, or any malicious code.
• Content that infringes third-party copyrights, trademarks, or other rights.
• Deepfakes or synthetic media created without the depicted person's consent.
• Use of the paid-delivery feature for activities restricted by our payment processor (see the full Acceptable Use Policy for the complete list).

6.4 Client licence

Upon successful payment, the Client receives a non-exclusive, non-transferable licence to use the downloaded files in accordance with the terms agreed with the Creator. SealTransfer is not responsible for any licence terms between Creator and Client beyond facilitating the delivery.

7. File storage and retention

Files are stored on our own European infrastructure, operated directly by No Fame GmbH. We do not use third-party cloud providers, hyperscalers, or subcontractors for the storage of your files. Per-Transfer size limits, personal storage quotas, and retention durations depend on the plan applicable to the Sender at the time of upload:

Retention starts from the date of Transfer creation. For paid plans, we will notify Creators by email at least 7 days before files are permanently deleted. Once deleted, files cannot be recovered. No Fame GmbH is not liable for loss of data following the expiry of the applicable retention period.

Uploaded files are scanned for malware for the sole purpose of protecting the Service and its users. Files identified as malicious are deleted and the associated account or IP address may be suspended. Files are never used to train artificial intelligence models, sold, shared with advertisers, or disclosed to any third party except as strictly required by applicable law.

8. Availability and liability

8.1 Service availability

We aim for 99.9% uptime but make no guarantee. Scheduled maintenance will be announced in advance where possible. No Fame GmbH is not liable for losses arising from service interruptions.

8.2 Limitation of liability

To the maximum extent permitted by Swiss law, No Fame GmbH's total liability to any Creator or Client shall not exceed the greater of: (a) the total platform fees paid by the Creator to No Fame GmbH in the 12 months preceding the claim; or (b) CHF 100. No Fame GmbH is not liable for indirect, incidental, special, or consequential damages.

8.3 No warranty

The Service is provided "as is". No Fame GmbH makes no warranties, express or implied, including warranties of merchantability or fitness for a particular purpose.

9. Governing law and dispute resolution

These Terms are governed by and construed in accordance with the laws of Switzerland, excluding conflict of law principles. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Zurich, Switzerland.
